Please read the following rules carefully before using our marketplaces. Your use of the Website is subject to the following Terms & Conditions of Use, which you are legally bound to accept by using the Website. If you are not prepared to comply with these terms you must leave the website immediately.

1. Introduction

  • 1.1. Racemarket.net is a classified ad website dedicated to racing. Therefore, you must not post ads for "normal" cars, bikes and equipment.
  • 1.2. Racemarket.net, "racemarket network", "racemarket", "we", "us", "our" means a brand owned and managed by New Tab, company registered in Slovenia(SI), registry number 8195340000 with its main office located at Ukmarjeva 4, 1000 Ljubljana.
  • 1.3. Please note that usage of the country names inside marketplace titles and displayed flags does not represent any connections, endorsement or affiliation with state or goverment institutions, it is only used for easier intepretation of each marketplace intended audience.

2. Copyright

The copyright and all other rights in the material on the Website are owned by Racemarket.net or are included with the permission of the owner of the rights.

3. Prohibited use

You agree not to use the Website:
  • to post non-racing ads. Ads for everyday usage cars,bikes and equipment will be removed without prior notice. If an user post a removed ad on site once again, it will recieve a warning from administrators and have exactly 24 hours to remove that ad, before its account will be terminated.
  • to create a database (electronic or otherwise) that includes material downloaded or otherwise obtained from the Website except where expressly permitted on the Website;
  • to disseminate advertisements on the Website or use the Website for any other commercial purposes (which would include using the Website to promote or encourage the sale of your goods/services);
  • to place links on the Website where those links take users to unlawful material or material that contravenes these Terms and Conditions;
  • to transmit or re-circulate any material obtained from the Website to any third party except where expressly permitted on the Website;
  • in such a way so as to remove the copyright or trade mark notice(s) from any copies of any material made in accordance with these Terms and Conditions;
  • to disseminate any unsolicited or unauthorised advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation;
  • to disseminate any material that contains software viruses or any other computer code, files or programs designed to interrupt, damage, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
  • to disseminate any material which is or may infringe the rights (including intellectual property rights) of any third party or be unlawful, threatening, defamatory, obscene, indecent, offensive, pornographic, abusive, liable to incite racial hatred, discriminatory, menacing, scandalous, inflammatory, blasphemous, in breach of confidence, in breach of privacy, which may cause annoyance or inconvenience or may restrict or inhibit the use of the Website by any person or which constitutes or encourages conduct that may be considered a criminal offence or give rise to civil liability in any country in the world;
  • to disseminate any material which compromises the privacy or security of anyone other than yourself;
  • to disseminate any material which does or may bring Racemarket.net or any of its brands or subsidiaries into dispute or in any way damage their reputation;
  • to disseminate any material where use of the material by Racemarket.net, or any third party licensed or permitted by Racemarket.net, will give rise to any third party claims; or
  • to post link(s) that take users to material that contravenes any of the above restrictions.

3.1. Advert rules

  • Normal ads do not expire until user marks item as sold (when moved to Sold category), however they could be marked as sold after 3 years but remain visible on the marketplaces.
  • User must not edit ad and replace its content (title,description, images and other data) with new item. Example: if an user is selling Subaru Impreza, it must not edit that ad (if Impreza was sold or not) and replace Impreza with Mitsubishi gearbox, as it will be considered as sold item and removed.
  • Translations: as our team does its best to provide accurate translations in all languages, it can come to certain mistakes in translation, for which we do apologise. Certain translations may be computer generated. When placing a new ad, please avoid using abbreviations (diffs etc) and slang words as it may cause mistranslation. We have translators, not your local mechanics. Some translations may be computer generated. Racemarket will not be liable for any translation errors resulting in misunderstandings and disputes during the sale process between seller and buyer. Seller is responsible for confirming the accuracy of the advert (listing), while buyer needs to get acquainted with all the details about the offered goods included in the sale.
  • Once an ad is paid and posted, you are not eligible for a refund (even if ad was removed by us due to non complying with these terms).
  • Credits are not exchangeable for money or refundable (remaining amount on your account).
  • Racemarket deserves the right to modify the ad titles or/and descriptions if it finds them innapropriate or insufficient in order to improve their chances of getting noticed by the buyers.
  • All inquiries are manually moderated before they are sent to the seller (owner of the advertised item) in order to prevent scam/spam messages. By submitting an inquiry through the contact form in each ad, the user/visitor agrees that its data will be submitted to the seller and data will be used by racemarket only for the purposes of this inquiry and will not be shared with any other 3rd party than the seller.

4. User Generated Content

The pages of the Website where you are capable of posting content are provided for your private, non-commercial exchange of lawful, relevant, fair and appropriate information, opinions and comment. Use of the Website that is inconsistent with those stated purposes is strictly prohibited. By submitting any content to the Website, you:
  • 4.1.1. grant Racemarket.net the worldwide, non-exclusive, royalty-free licence to use such content and all material embodied therein for any purposes including, without limitation, to use, modify, distribute, edit, copy, reproduce, translate, disclose, post and/or remove such content from the Website. In case of accounts, registered as "company", you grant the permission to use your brand name and graphics (logos, copyrighted or not) in certain parts of the Website, which is to be publicly displayed to other visitors. If you do not wish to grant this permission, let us know immediately after registration or anytime later on and we'll remove it immediately.
  • 4.1.2. warrant to Racemarket.net that all such content complies with the provisions of Clause 3; and
  • 4.1.3. acknowledge that Racemarket.net may require you to confirm the above rights and warranties and agree to do so within 7 days of any request from Racemarket.net.
  • 4.2. Racemarket.net reserves the right (but not the obligation) at its sole discretion to refuse, review edit, move or remove any content that is posted to, or available on, the Website without the need to give any reasons for doing so. However, Racemarket.net will not review the materials that you or anyone else makes to the Website and therefore, unless we are specifically notified of the nature of any item of content, you cannot assume that Racemarket.net is aware of it. If you object to the publication of any material placed on the Website please contact Racemarket.net using the contact details shown on the »contact us« page of the Website and we will take whatever action we deem appropriate.
  • 4.3. Racemarket.net accepts no responsibility for any statements, material or other submissions placed by you or any third party, or for any loss or damage resulting from your breach of these Terms and Conditions.
  • 4.4. may place ads for single items actually for sale only, not to promote its services or many products at once. To promote your services we offer banner advertising or ShopPack ads.

5. Links from other websites

You may link to the Website but strictly only on the basis that you do not replicate the pages of the Website, and subject to the following conditions:
  • 5.1.1. you do not create a frame or any other browser or border environment around the Website;
  • 5.1.2. you do not in any way imply any endorsement by Racemarket.net other than with its written consent or misrepresent your relationship with Racemarket.net;
  • 5.1.3. you do not use any logos or trade marks displayed on the Website without the express written permission of Racemarket.net;
  • 5.1.4. you do not link from a website that is not owned by you; and
  • 5.1.5. your website does not contain content that is distasteful, offensive or controversial, that infringes any intellectual property rights or other rights of any other person or otherwise does not comply with all applicable laws and regulations.

6. Trade Marks

Racemarket.net trade marks (whether registered or unregistered) and graphics, logos, designs, page headers and button icons are the intellectual property rights of Racemarket.net and neither they nor any confusingly similar versions may be used by you including (but not limited to) as part of any trade marks and/or domain names without the prior written consent of Racemarket.net other than for the purpose of referring to Racemarket.net and its associated brands lawfully and in good faith (only).

7. Registration

  • 7.1. To access certain parts of the Website, Racemarket.net may require you to register and provide certain information about yourself. Such registration shall be subject to specific terms of registration. Where you register you also agree to:
  • 7.1.1. provide true, accurate, current and complete information about yourself as prompted by the relevant registration form (such information being the "Registration Data"); and
  • 7.1.2. maintain and promptly update the Registration Data to keep it fully up to date.
  • 7.2. Where you register on the Website, you will be allocated a user name and password. These account details must be used solely by you; sharing your user name and password with any other person or making it available to multiple users on a network is strictly prohibited. Accordingly, you agree to:
  • 7.2.1. maintain the security of your user name and password and be fully responsible for all use of the Website made using your user name and password;
  • 7.2.2. immediately notify Racemarket.net if you become aware of any unauthorised use of your user name and password or any other breach of security by sending an appropriately worded email to the contact details shown on the »contact us« page of the Website; and
  • 7.2.3. ensure that you exit from your website account at the end of each session.
  • 7.2.4. racemarket.net will never ask for your password, if you receive a request via mail or others for your password, DO NOT send it back, it's probably a scam, which we cannot control. Racemarket.net cannot and will not be liable for any losses, damages or costs arising from your failure to comply with these requirements.

8. Disclaimer

  • 8.1. Whilst Racemarket.net endeavours to ensure that the Website is normally available 24 hours a day, due to the inherent nature of the Internet, errors, interruptions and delays may occur in the service at any time. Accordingly, the Website is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind and we do not accept any liability arising from any interruption in availability. Access to the Website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for any other reasonable cause.
  • 8.2. You acknowledge that whilst Racemarket.net endeavours to ensure that information on the Website and any related material provided to you by Racemarket.net, whether by email or otherwise (“the Racemarket.net Materials”) is accurate and complete, it is provided only for general information, is not intended to address your particular requirements and does not constitute any form of advice or recommendation by Racemarket.net. You acknowledge that the information on the Website does not necessarily reflect the views and opinions of Racemarket.net or any of its brands and that the Racemarket.net Materials should not be relied upon by you in making (or refraining from making) any specific investment or other business or personal decisions and acknowledge that professional advice should be obtained before making any such decision.
  • 8.3. You acknowledge that some of the content may be supplied by third parties and the accuracy and completeness of it will not have been checked by Racemarket.net. No liability shall be accepted by Racemarket.net for any inaccuracy or omission in the information provided on the Website or the Racemarket.net Materials. All implied warranties are excluded from these Terms and Conditions to the extent that they may be excluded as a matter of law.
  • 8.4. Racemarket.net will use reasonable endeavours to ensure that the Website and the Racemarket.net Materials do not contain or promulgate any viruses or other malicious code. However, it is recommended that you should virus check all such materials and regularly check for the presence of viruses and other malicious code. Racemarket.net excludes to the fullest extent permitted by applicable laws all liability in connection with any damage or loss caused by computer viruses or other malicious code originating or contracted from the Website or the Racemarket.net Materials.
  • 8.5. Racemarket.net shall not be liable for any damages and losses (including, without limitation, damages for loss of the profits, indemnity, confidentiality and data breach) arising in contract, tort or otherwise from your use or inability to use the Website or any content or from any action taken (or refrained from being taken) as a result of using the Website or any content of it, including in respect of infringement of third party rights arising from the your use of the content, fraud, death and any other losses which cannot be excluded or limited by applicable law. All transactions and all agreements between buyers and sellers are made entirely at their own risk, racemarket.net is not aware of these, does not control them and will not be liable for frauds, fraud claims and any other similar inconvenience that may occur between two parties as a result of use of Website or any content.
  • 8.6. Links on the Website to third party websites are provided solely for your convenience. If you use these links, you leave the Website. Racemarket.net has not reviewed these third party websites and does not control and is not responsible for these websites or their content or availability. Racemarket.net therefore does not endorse or make any representations about them, or any material found on them, or any results that may be obtained from using them. If you decide to access any of the third party websites linked to the Website, you do so entirely at your own risk. Please note that Racemarket.net gives no warranty that links to third party sites on the Site shall be marked as such.
  • 8.7. The Website may contain links to third party websites where you may purchase items. You acknowledge that when making a purchase from a third party website you enter into a contract with that third party at your own risk and Racemarket.net will bear no liability for that contract. Please note that third parties may operate such shopping sites with reference to the name of the Website, but that does not mean that Racemarket.net are responsible for their conduct or any contracts that you enter into with them.
  • 8.8. The Website may from time to time contain advertising and sponsorship. Racemarket.net is not responsible for either the content of the material provided by such advertisers and sponsors or their compliance with voluntary or statutory codes or provisions. In particular, Racemarket.net can provide no warranty that it will not take advertisements or sponsorship from your competitors.
  • 8.9. Commission sales - all items offered in a "commission sales" service and listed under account names that include "racemarket" ("Racemarket Sales e.g.) advertise items, owned by clients, which have not been inspected by Racemarket, who is not aware of its whereabouts and its condition apart from the information that has been received from the owner itself. Racemarket will not be liable for any damages and losses and does not provide any guarantees (Article 8.5 apply). Owner is responsible for confirming the accuracy of the advert and communication, while the buyer needs to get acquainted with all the details about the offered goods included in the sale before making any payments. Any dispute shall be resolved between the buyer and the seller, without racemarket involvement.

9. Suspension of access to the Website and User Indemnities

  • 9.1. If, for any reason, Racemarket.net believes that you have not complied with any of these Terms & Conditions it may, at its sole discretion, suspend or cancel your access to all or some of the Website immediately and without giving you any advance notice.
  • 9.2. Without prejudice to the provisions of Clause 10, you agree to compensate Racemarket.net in respect of any claims, losses, expenses and/or liabilities (including legal fees) which arise from your use of the Website and/or the Racemarket.net Materials (or by a third party using your user name and password) including in particular (but not limited to) any statements, contributions or other content posted on the Website.
  • 9.3. If your ad / ads / account was suspended, you are not eligible for a refund for already paid services and remaining balance in your account.

10. Limitation of Racemarket.net’s Liability

  • 10.1. Racemarket.net will not be liable to you for any loss or damage caused by Racemarket.net or its employees (more in rule 8.5).

11. Make an offer

  • 11.1. "Make an offer" is the functionality that can be used by users - potential buyers to submit their offer to acquire an item listed on the marketplace.
  • 11.2. Your use of the functionality is subject to the following Terms & Conditions of Use described in clause 11, which you are legally bound to accept together with other clauses affecting general usage of the website.
  • 11.3. Seller can choose to enable the functionality by selecting the "enable make an offer" option during ad submission or later editing. By enabling the functionality, seller agrees to comply with regulations as stated in clause 11.2. Once enabled, the selected listing gets a "make an offer" button, which users (potential buyers) can use to submit their offers to acquire listed goods. Buyers agree to comply with the regulations by submitting an offer. Seller can review all the recived offers inside its user account in the "Offer" tab and can choose to either "decline" those who are deemed non-suitable or to "accept" the one that is.
    Once accepted, the buyer that submitted the accepted offer, is notified via email and has up to 48 hours to prove its seriousness by depositing the proposed amount in a secure escrow account. In case buyer fails do to so, the seller is allowed to accept another offer (if suitable), but must clearly inform the first buyer that his offer is not valid anymore. Failure to do so, may result into buyer making the deposit later, which by escrow provider terms can be refunded, but will be charged escrow fees which are non-refundable and therefore experience damage, that we cannot be held responsible for.
    If the buyer fails to fulfill his offer in a timely manner and does not provide a reason to do so, the buyer will no longer be permitted to submit offers on any listings visible on racemarket network.
    Once the buyer makes the payment and initiates the escrow process, it is up to seller and buyer to discuss further details, sale contract, pickup or delivery, which are not in awareness of racemarket.
  • 11.4. By using the functionality you agree that you are solely responsible for all costs, expenses and damages that you may incur as well as complying with local law, where applicable.
  • 11.5. Seller is responsible for confirming the accuracy of the advert (listing), while buyer needs to get acquainted with all the details about the offered goods included in the sale. Racemarket is not included or involved in the contract between seller and buyer, is not aware about the goods condition and does not carry any inspection of the cars and parts offered by users. Racemarket cannot be held responsible for any dispute, loss or damage, as a result of incorrect description provided by the seller or its (mis)translations on other marketplaces.
  • 11.6. Escrow: to protect both parties ("seller" and "buyer"), all payments for accepted offers are processed via trustshare escrow and are subject to their Terms and Conditions. By submitting or accepting the offer, both parties agree that escrow will be used to complete the payment. There are no escrow fees for the seller, while the buyer needs to pay the fee in amount of 3% of the agreed sale amount with the first deposit. Fees are not refundable. When paying in different currencies, there may be some alterations in the amount due to an exchange rate, which is provided by escrow service and subject to their Terms and conditions. In case escrow is not used once the offer is accepted, racemarket is entitled to a commission in the amount of 4% of the agreed amount, which is due to be paid by the seller. Racemarket.net network is not responsible nor directly included in any transaction processed through trustshare as a result of agreement via our network. The checkout process may contain racemarket branding including logo for the purpose of legitimacy and racemarket brand name in the checkout "to" field to protect seller identity, but racemarket network is never the recipient of the deposit, trustshare is.
  • 11.7. Any dispute shall be resolved between the buyer and the seller, without racemarket involvement. Racemarket reserves the right to remove the offer that we deem unserious before it's sent to seller's consideration.
  • 11.8. Personal data submitted in the offer form will only be used for the purposes of the offer, reviewed by racemarket team and sent to the seller and will not be shared to any 3rd party.

Variation of these Terms & Conditions of Use

Racemarket.net reserves the right to vary these Terms & Conditions of Use from time to time. Such variations become effective immediately upon the posting of the varied Terms & Conditions on the Website. By continuing to use the Website you will be deemed to accept such variations. You should therefore check the Website from time to time to review the then current Terms & Conditions. These Terms & Conditions were last updated on July 1st 2022.


Privacy policy

This Privacy Policy governs the manner in which racemarket.net collects, uses, maintains and discloses information collected from users (each, a "User") of the http://racemarket.net website ("Site"). This privacy policy applies to the Site and all products and services offered by racemarket.net.

Personal identification information
We may collect personal identification information from Users in a variety of ways, including, but not limited to, when Users visit our site, register on the site, and in connection with other activities, services, features or resources we make available on our Site. Users may be asked for, as appropriate, name, email address, phone number. Users may, however, visit our Site anonymously. Users have the right to transfer or download its data by requesting it at info@racemarket.net.
Personal data submitted using "Contact seller" form will be held for moderation by racemarket.net and after review shared only to the author of the ad that form was submitted in, it will not be stored or used for any other purposes.

Non-personal identification information
We may collect non-personal identification information about Users interacting with our site, but only if they agree to do so by clicking "I allow" in cookie bar. Non-personal identification information may include the browser name, the type of computer and technical information about Users means of connection to our Site, such as the operating system and the Internet service providers utilized and other similar information.

Web browser cookies
Our Site may use "cookies" to enhance User experience and follow statistics. User's web browser places cookies on their hard drive for record-keeping purposes and sometimes to track information about them. Only strictly necessary cookies, required for basic website functionalities, are installed automatically and do not require User's consent, while others (3rd party), like Analytics, Google Adsense, Facebook pixel etc. do. How we protect your information

We protect your email address from unsolicited email by not allowing it to be displayed publicly inside ad descriptions.

Sharing your personal information
We do not sell, trade, or rent Users personal identification information to others. We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and users with our business partners, trusted affiliates and advertisers for the purposes outlined above. We may share ads which includes your publicly visible personal data on social networks with the goal of improving ad reach and better sale chances. In case of company accounts, the system may automatically find and attach the logos to your profile, which we can display on various parts of the website, including as a reference of current users to promote our services. If you do not wish your logo to be displayed, let us know immediately.

Provision of the online services and webhosting

In order to provide our online services securely and efficiently, we use the services of one or more web hosting providers, from whose servers (or servers managed by them) the online offer can be accessed. For these purposes, we may use infrastructure and platform services, computing capacity, storage space and database services, as well as security services and technical maintenance services.
The data processed as part of the provision of the hosting offer may include all information relating to the users of our online offer, which is generated as part of the use and communication. This regularly includes the IP address, which is necessary to be able to deliver the contents of online offers to browsers, and all entries made within our online offer or from websites.
E-mail dispatch and hosting: The web hosting services we use also include the dispatch, receipt and storage of e-mails.
